Please be advised that on June 14, 2013, the Ministry of Labor and Social Provision published in the Official Gazette of the Federation, the decree that states the administrative criteria, requirements and application formats in order to carry out the procedures and request the services with respect to training and productivity of the employees. This decree among other issues states the obligation of any employer that has over 50 employees to incorporate a Mixed Training and Productivity Commission. The provisions of the abovementioned decree are effective as of June 15, 2013.
Additionally, please be advised that Article 153-E of the Mexican Federal Labor Law (MFLL) states that in those companies that have over 50 employees the Mixed Training and Productivity Commission shall be created. Furthermore, Article 153-F of the MFLL states that labor authorities must make sure that such Commissions are created in every company, keep functioning and complying with its obligations. Lastly, Article 132 Section XXVIII of the corresponding law states as an obligation of the employer to participate in the creation and functioning of any commission provided by law.
