New Mandatory Rules in Mexican Data Protection (IFAI)
Please be advised that on March 4, 2014, the Mexican Federal Institute of Access to Information and Data Protection “IFAI” published in the Official Gazette of the Federation, the Decree that delegates to the Secretary of the Protection of Personal Data several authorities in order to issue jointly with the General Directors stated therein several decrees with respect to the verification procedures, rights protection and imposing of fines, in its case.
These provisions are established in order to effectively guarantee the rights of access, rectification, cancellation and opposition that is exercised by their holders, and to exercise monitoring and verification capacity and, if necessary, to impose penalties/fines for violations or infractions made by those responsible in charge of the obligation to protect the corresponding information/data.
Finally, please be advised that Ernesto Velarde – Danache, Inc., has the experience to provide assistance in the preparation, review and improvement of the Privacy Notice as well as the implementation of the corresponding software to prevent fines from the “IFAI”.
